Scope. This Privacy Policy applies solely to www.block9.app and the consulting, education, workshop, and merchandise services offered by Block9 LLC. It does not apply to other Block9-affiliated products or applications — including Agents by Block9 at agents.vb9.app — which are governed by their own separate privacy policies.

Block9 LLC ("Block9," "we," "us," or "our") operates this website and store, including all related information, content, features, tools, products, and services (the "Services"). Block9 is powered by Shopify. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described herein.

Personal Information We Collect or Process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified. We may collect or process the following categories, including inferences drawn from them, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

  • Contact details — your name, address, billing address, shipping address, phone number, and email address.
  • Financial information — payment card information, financial account information, transaction details, form of payment, payment confirmation, and other payment details. Full payment card and bank account numbers are handled by our payment processors and are not stored by Block9.
  • Account information — username, password, security questions, preferences, and settings.
  • Transaction information — items you view, put in your cart, add to your wishlist, or purchase, return, exchange, or cancel, and your past transactions.
  • Communications with us — information you include in communications with us, for example when sending a customer support inquiry or submitting a contact form.
  • Voice and AI chat data — audio of your voice captured through your microphone or telephone when you choose to speak with our AI assistant, transcripts of those conversations, and any information you volunteer during them (such as your name and contact details if you request a follow-up). See "AI Assistant and Voice Chat" below.
  • Professional information — job title, company name, and business contact information when you engage Block9 on behalf of an employer.
  • Device information — information about your device, browser, or network connection, your IP address, and other unique identifiers.
  • Usage information — information regarding your interaction with the Services, including how and when you interact with or navigate the Services. This is collected in part through cookies and similar technologies, including analytics tools such as Google Analytics, subject to the choices you make in our cookie banner.

Blockchain Transaction Data

When you make a peer-to-peer cryptocurrency payment to Block9, the transaction is recorded on a public blockchain. Blockchain transaction data (including wallet addresses, amounts, and timestamps) is publicly visible and outside Block9's control. Block9 does not associate your wallet address with your personal information except to the limited extent necessary to confirm payment of a specific invoice. We cannot remove, alter, or anonymize on-chain data. See our Blockchain & Cryptocurrency Privacy Addendum for detail.

Personal Information Sources

  • Directly from you, including when you create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information.
  • Automatically through the Services, including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies.
  • From our service providers, including when we engage them to enable certain technology and when they collect or process your personal information on our behalf.
  • From our partners or other third parties.

How We Use Your Personal Information

  • Provide, Tailor, and Improve the Services. To provide you with the Services, perform our contract with you, process your payments, fulfill your orders, remember your preferences, send notifications related to your account, process purchases, returns, exchanges, or other transactions, create and manage your account, arrange shipping, facilitate returns and exchanges, enable you to post reviews, and create a customized experience.
  • Marketing and Advertising. To send marketing, advertising, and promotional communications by email or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously purchased or added to your cart.
  • Security and Fraud Prevention. To authenticate your account, provide a secure payment and shopping experience, detect, investigate, or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and secure our Services. If you register an account, you are responsible for keeping your credentials safe. We strongly recommend that you do not share your username, password, or other access details with anyone.
  • Communicating with You. To provide customer support, be responsive to you, deliver effective services, and maintain our business relationship.
  • Legal Reasons. To comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies; to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings; and to enforce or investigate potential violations of our terms or policies.

How We Disclose Personal Information

  • With Shopify (hosting and commerce), xAI Corp. (which processes voice and text conversations with our AI assistant), Google (analytics services such as Google Analytics), and other vendors and third parties who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, cloud storage, fulfillment, and shipping). Google's use of information is described in Google's own privacy policy, and you can control analytics cookies through our cookie banner.
  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements based on your online activity with different merchants and websites. See "How to Opt Out of Sale or Sharing" below.
  • When you direct, request, or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.
  • In connection with a business transaction such as a merger or bankruptcy; to comply with applicable legal obligations (including to respond to subpoenas, search warrants, and similar requests); to enforce any applicable terms of service or policies; and to protect or defend the Services, our rights, and the rights of our users or others.

AI Assistant and Voice Chat

Our website and telephone line offer an optional assistant ("AgentB9") that lets you speak or chat with an artificial intelligence agent about Block9 and our services. AgentB9 is an AI, not a human, and identifies itself as such at the start of each conversation.

Your choice. The website assistant activates only when you choose to start a conversation and grant your browser permission to use your microphone. It does not listen passively, and it is not available until you have accepted analytics cookies through our cookie banner. You may end a conversation at any time, and conversations are limited in duration.

Telephone calls. The same assistant answers our published phone number on a recorded line, and discloses both its AI status and the recording at the start of each call. If you prefer not to be recorded, you may end the call and contact us by email at sales@block9.app or support@block9.app instead.

How it works. When you speak with AgentB9, your voice audio is transmitted to xAI Corp., the artificial-intelligence provider whose technology powers the assistant, where it is processed to generate the assistant's spoken responses and a transcript. We may review conversation transcripts to provide follow-up you request, to improve the assistant's accuracy, and for quality and safety monitoring. If you ask us to contact you, the details you provide (such as your name, email address, or phone number) are saved to our systems so our team can follow up.

Voice audio is not used to identify you. Block9 does not use voice recordings or transcripts to create a voiceprint, voice template, or other biometric identifier, and does not use them to identify or authenticate individuals. Audio is processed solely to understand what you said and generate a response.

Retention. Per xAI's API data practices as of the Last Updated date, xAI retains API conversation data for a limited period for trust-and-safety monitoring and does not use it to train its models. Transcripts and recordings we retain are kept in accordance with the "Data Retention" section below.

A note on sensitive information. Please do not share sensitive personal information (such as government identifiers, financial account credentials, health information, or wallet seed phrases or private keys) with the assistant. It does not need this information, and we ask that you never provide it.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify.

To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights. Third Party Websites and Links

The Services may provide links to websites or other online platforms operated by third parties, including affiliate partners. If you follow links to sites not affiliated with or controlled by us, you should review their privacy and security policies and other terms. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on those sites. Information you provide on public or semi-public venues, including third-party social networking platforms, may be viewable by others without limitation as to its use. Our inclusion of such links does not imply endorsement.

Children's Data

The Services are intended for users 18 years of age or older. We do not knowingly collect personal information from anyone under the age of 18. If you are the parent or guardian of a child who has provided us with personal information, you may contact us using the details below to request that it be deleted. As of the Last Updated date, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Communications and SMS

We may send you promotional emails, and you may opt out at any time using the unsubscribe option in our emails. If you opt out, we may still send you non-promotional emails, such as those about your account, bookings, or orders.

If you provide your phone number to Block9, you may receive transactional communications related to your bookings, services, or orders (for example, an appointment confirmation or shipping update). Block9 does not send promotional SMS or marketing text messages without separate, express consent. Standard message and data rates may apply. You may opt out of transactional SMS at any time by replying STOP.

Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information, including access controls, encryption in transit, and vendor due diligence. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." Any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us, and that you never share your seed phrase, private keys, or wallet recovery materials with anyone, including Block9.

In the event of a data breach affecting your personal information, we will notify you and applicable regulators as required by law.

Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy. Our general practice:

Where personal information is no longer needed for any purpose above, we delete or de-identify it. Retention periods may be extended where required to comply with a legal obligation, resolve a dispute, or enforce our agreements. Data recorded on a public blockchain cannot be deleted by Block9 or anyone else.

Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline your request as permitted by law.

  • Right to Access / Know. Request access to personal information we hold about you.
  • Right to Delete. Request that we delete personal information we maintain about you.
  • Right to Correct. Request that we correct inaccurate personal information.
  • Right of Portability. Receive a copy of the personal information we hold about you and request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  • Right to Opt Out of Sale or Sharing for Targeted Advertising. See below.
  • Right to Non-Discrimination. We will not deny services, charge different prices, or provide a different level or quality of service because you exercised any of these rights.

How to Opt Out of Sale or Sharing

Block9 does not sell personal information for monetary consideration. We may engage in "sharing" for cross-context behavioral advertising when our Site uses third-party advertising or analytics tools. You may opt out in any of the following ways:

  1. Use our data sharing opt-out page. A dedicated opt-out control is available at [DATA-SHARING-OPT-OUT-URL] and linked from the footer of every page. This control is provided for residents of states whose laws grant an opt-out right, and it records your preference directly. If you are located in one of those states, this is the fastest and most reliable method.
  2. Use our cookie banner. Select "Decline" or adjust your preferences to withhold consent for advertising and analytics cookies. You can reopen the banner at any time from any page.
  3. Enable Global Privacy Control (GPC). If you visit our website with the GPC opt-out preference signal enabled, we will treat it as a request to opt out for the device and browser you used. If we can associate that device with a Shopify account, we will apply the opt-out to the account as well. Learn more at globalprivacycontrol.org.
  4. Email us. Send a request to privacy@block9.app with the subject line "Opt Out." Include the email address associated with your account or orders so we can locate your records. We will confirm within ten (10) business days. We honor these requests regardless of where you live, including from states whose laws do not require it.
  5. Use our contact form at www.block9.app/pages/contact, noting "Privacy request" in the comment field.

Methods 1 through 3 apply to the specific browser and device you use. If you switch browsers or devices, or clear your cookies, you will need to opt out again there. A request submitted by email or contact form is applied to your account records.

Other than Global Privacy Control, we do not recognize "Do Not Track" signals sent from web browsers or devices.

Submitting a Rights Request

You may exercise any of these rights by contacting us at privacy@block9.app or through our contact form. We may need to verify your identity before processing your request, as permitted or required under applicable law. Verification may include matching information you provide against information already in our records.

You may designate an authorized agent to make requests on your behalf. Before accepting a request from an agent, we will require written proof that you authorized them, and we may need to verify your identity directly.

We will confirm receipt within ten (10) business days and respond substantively within forty-five (45) calendar days, with one extension of up to forty-five (45) additional days where reasonably necessary and with notice to you.

Complaints and Appeals

If you have complaints about how we process your personal information, please contact us at privacy@block9.app. If we decline a request, you may appeal by replying to our response or emailing privacy@block9.app with the subject line "Privacy Appeal." We will respond to appeals within forty-five (45) days. Depending on where you live, you may also have the right to lodge a complaint with your state attorney general or local data protection authority.

International Users and Data Transfers

Block9 LLC is based in the United States and primarily serves customers within the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data-protection laws may differ from those in your jurisdiction. By using the Services, you consent to that transfer.

If we expand our operations to receive personal information from individuals located in the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, or equivalent contracts issued by the relevant competent authority of the United Kingdom, unless the transfer is to a country determined to provide an adequate level of protection.
